Terms of Sales

The General Conditions of Sale are intended to define the conditions under which the sales of products are made.

Article 1: object

The general conditions of sale described below define the conditions applicable to any purchase made on the site hirondelle-bijoux.fr (hereinafter referred to as the "seller") and its customer (hereinafter referred to as the "buyer") .
Any order placed on this site therefore implies the buyer's unreserved acceptance of these general conditions of sale. The seller reserves the right to modify its conditions of sale at any time and in this case, will announce it on its site. The applicable conditions will be those in force on the date of the order by the buyer.

Article 2 - Price

The prices of the products sold are those in effect on the day the order is taken. They are denominated in euros, all taxes included, VAT not being applicable (Article 923B of the General Tax Code).
The prices indicated on the site www.hirondelle-bijoux.fr do not include shipping costs which are invoiced in addition to the price of the items purchased. Shipping costs will be indicated when the order is registered by the buyer.
All customs duties or other local taxes that may be required for foreign countries are the sole responsibility of the buyer and under his responsibility.
The seller grants himself the right to modify his prices at any time. However, he undertakes to invoice the goods ordered at the prices indicated when the order is registered.

Article 3 - Order taking

All orders are made on the site www.hirondelle-bijoux.fr , following the instructions communicated on the site for this purpose.
The information given by the buyer, when taking the order, is binding on him. In the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of the correct delivery of the product.
Orders are only final when they have been confirmed by the buyer's payment.
Upon validation of your order, Hirondelle bijoux will send you an order confirmation e-mail containing your entire order (nature of the products ordered, quantity and price, shipping address).

Article 4 - Terms of payment

The payment of orders is made by:

- Credit card via a secure payment system or by credit card via the Paypal.fr secure payment system

Following the registration of the order, the buyer must pay the full amount of the order, which will only be sent upon receipt of payment and its validation by the bank.
The seller reserves the right to cancel or refuse any order from a buyer with whom there is a previous payment dispute.

Article 5 - Availability

In case of unavailability of product after placing the order, the buyer will be informed by email of the delivery of a partial order or the cancellation of his order. If the debit has already occurred at the time of the information given on the unavailability of the product, a request for reimbursement of the sums incurred is made. An information email is then sent to the buyer on this subject.

Article 6 - Delivery

Delivery is made to the place indicated by the buyer when purchasing on the site. Hirondelle-bijoux.fr is in no way responsible for any error in entering the buyer's address and cannot return the goods.
The delivery time indicated when registering the order is given for information only and is in no way guaranteed.
Consequently, any reasonable delay in the delivery of the products cannot give rise, for the benefit of the buyer, to the allocation of damages or the cancellation of the order.
In the event of missing or damaged goods, the buyer must formulate all the necessary reservations with Hirondelle bijoux upon receipt of the said goods.
These reservations must also be sent in writing within five days of delivery by email to hirondellebijoux@gmail.com

Article 8 - Responsibilities

The seller's liability cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure.
As such, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.
The responsibility of the seller cannot also be implemented in the event of disruption, theft, total or partial strike, of the postal services.

Article 9 - Protection of personal data

The information and personal data concerning the buyer are necessary for the processing of orders and commercial relations. However, within the framework of compliance with the Data Protection Acts and in application of article 27 of law 78-17 of January 6, 1978, Hirondelle bijoux undertakes not to disseminate this information to a third party or to any commercial organization.

Article 10 - Intellectual property

All articles on the hirondelle-bijoux.fr website are and remain the exclusive intellectual property of Hirondelle bijoux .
The models presented on this site are the exclusive property of Hirondelle bijoux , reproduction prohibited, even partial.
No reproduction, even partial, can be made of this site without the written authorization of Hirondelle bijoux .

All personal information you provide us with or that we obtain will be handled by Hirondelle as responsible for the personal information. The personal information you provide will be used to ensure deliveries to you, the credit assessment, to provide offers and information on our catalog to you. The information you provide is only available to Hirondelle and Tictail and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request Swallow to delete or correct the information held about you. By accepting the swallow's Conditions, you agree to the above.


Force Majeure

Events outside Hirondelle's control, which is not reasonably foreseeable, shall be considered force majeure, meaning that Hirondelle is released from Hirondelle's obligations to fulfill contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.


payment

All products remain Hirondelle's property until full payment is made. The applicable price is that set at the date on which you place your order. Shipping costs and payment fees are recognized before confirming the purchase. If you are under 18 years old you must have parents' permission to buy from Hirondelle.

All transfers conducted through Hirondelle are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.


Local Tax

Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers own expense.

Hirondelle uses cookies according to the new Electronic Communications Act, which came into force on 25 July 2003. A cookie is a small text file stored on your computer that contains information that helps the website to identify and track the visitor. Cookies do no harm to your computer, consist only of text, can not contain viruses and occupies virtually no space on your hard drive. Additional Information

Hirondelle reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, Hirondelle has the right to cancel the order and refund any amount paid in the best way. Hirondelle shall also notify the customer of equivalent replacement products if available.

Tictail AB is not responsible for any content, interactions or transfers made on Hirondelle.

Dispatch

Delivery is made to the place indicated by the buyer when purchasing on the site. Hirondelle-bijoux.fr is in no way responsible for any error in entering the buyer's address and cannot return or refund the goods.
The delivery time, from 2 to 7 days, is given as an indication and is in no way guaranteed.
Consequently, any reasonable delay in the delivery of the products cannot give rise, for the benefit of the buyer, to the allocation of damages or the cancellation of the order.
In the event of missing or damaged goods, the buyer must formulate all the necessary reservations with Hirondelle bijoux upon receipt of the said goods.
These reservations must also be sent in writing within five days of delivery by email to hirondellebijoux@gmail.com

Right of withdrawal and return of products

In accordance with article L.121-20 of the Consumer Code, for any distance selling operation, the buyer has a period of 14 days from the delivery of his order to return the product to the seller, for exchange only, without penalties except for the return costs which remain the responsibility of the buyer (see terms below).

- The item(s) purchased by the customer must be in perfect condition, well packaged and must not show any scratches, stains or other defects.
Our quality control carefully checks all our creations before sending the order.

- The photos of the jewels presented on our site are not contractual: Each stone is unique. The jewels sent may therefore have different shades from those offered in the photo on the site. No exchange will be made based on this reason.

- Important : Our jewels must not be put in contact with water or corrosive products and will therefore not be exchanged in this case.

- No exchange will be considered if an item arriving broken has not been declared to Hirondelle bijoux within 5 days of receipt of the order.

- Regarding special orders, no refund will be accepted by Hirondelle bijoux.

- In the event that the dimension chosen for the wrist or finger does not correspond, Hirondelle bijoux undertakes to proceed with the exchange within the limits of available stocks.

- Before any return, a request for a photo of the product(s) purchased by the customer will be required, in order to see if the item(s) received meet all the return conditions.
After acceptance of the return by Hirondelle bijoux, the buyer will have the choice of carrier (La Poste or other) and must provide a tracking number to be sent by email to hirondellebijoux@gmail.com.


Our Return Policy in short

  • You can return the product within 14 days of delivery.

  • To avoid any Customs charges please clearly mark the package “RETURNED GOODS”

Return Policy

Please contact Hirondelle before returning any items.

It is appropriate that the consumer controls the delivery to verify that this is accurate and error free. At the complaint, the customer contacts Hirondelle and gives relevant information and the reason for complaint.

Return Conditions

You can return the product within 7 days of delivery. The product must be in new condition. If the product is ruined or used the product shall not be refunded. Make sure to include contact information with the return and if possible, please provide us with a tracking number. Hirondelle suggests you get a receipt and a package ID for the return from the delivery service, as it makes it easier to follow the return shipment if needed.

Hirondelle will make a refund of eligible returns. If you paid by invoice, we will need a bank account number to transfer the money back to. The easiest way is to e-mail it to us along with a brief description of your case.

Returning A Package

If a returned item is shipped internationally, please clearly mark the package 'RETURNED GOODS', to avoid any Customs charges. Hirondelle is NOT responsible for any return Customs charges made. Any charges incurred are the responsibility of the customer.

Transportation Damage

If the product is lost or you, upon receiving, notice that the item has been damaged during transport, you should immediately report this to us.

Unclaimed Packages

For packages that are not cashed at your post office within 14 days, Hirondelle reserves the right to charge you a handling fee to cover return shipping and freight companies' administrative costs.
